Wakf validating Bill(Act) of 1913 was an act to declare Mussalman's right to make settlements for their 'families, children and descendants of property by way of wakf'.
Explanation:
- "Wakf" means a continuous devotion to any land, which is recognized by Mussalman law as political, religious or charitable, by a person professing the Muslim faith.
- Every individual professing the Mussalman's faith shall be allowed to establish a wakf, which is in compliance with Mussalman law for all other purposes, including the following: for the support and maintenance of his family, children or offspring in whole or in part; and where the creator of the wakf is an Hanafi Mussalman, he or she is also to support him or her in his or her lifetime or to pay his or her debts out of the rents and income of a house.
- Provided that, in those cases, the ultimate benefit shall be explicitly or 'implicitly reserved for the poor' or any other purpose that is recognized as a 'permanent religious', 'pious or charitable purpose by the Mussalman law'
- Such a Wakf is not void merely because it is delayed until after the demise of the family or children or the descendants of the person making the Wakf the profit reserved therein for an underprivileged or other religious or holy reason or charitable intent of a permanent nature.
