The court said Hakim Sheik 's problems may have cost him his life. If a hospital is incapable of providing a person with prompt medical care, it means that life is not protected. The Court has noted that the government is obligated to offer the health care it provides, including treatment in emergencies. Hospitals and medical staff must fulfill their critical care criteria. Since  various govt. hospitals refused to admit Hakim Sheikh, the State Govt was asked to give Hakim Sheik the money which  he had spent on his treatment.

Explanation:

  • Hakim Sheik was a founder of the West Bengal farm workers' union Paschim Banga Khet Mazdoor Samity (PBKMS). He mistakenly fell off a moving train one evening in 1992 and  sustained injuries. He was very serious and needed to be treated immediately.
  • He was admitted to a govt. hospital in Kolkata, however because they had no substitute bed they refused to accept him. There was no equipment or specialist physicians essential to his care at another hospital. He was taken in a critical state in 8 different govt. hospitals for almost 14 hours, however none admitted him. Finally, in a private hospital, he received treatment.
  • He had spent much money on his treatment. Hakim Sheik and the PBKMS brought a case before the court in frustration and indignation at the negligence of all the hospitals which declined to admit him.
