Shakuntala and Srinivas were living with four sons Subhash, Laxman, Vinod and Ram Avtar and two daughters. Subash was married to Madhu. Laxman was married to Sudha (the Victim).

The Incident

On December 1, 1980, after 9 pm, the neighbors of Sudha heard screams for help and ran to her house. They saw Sudha in fire and Laxman and Subash nearby. The neighbors put out the flame and took Sudha to the hospital accompanied by her husband and sister on the way.

Sudha died next day morning at the hospital. Sudha had given an oral declaration and had signed a written statement accusing her mother-in-law of the act.

Trial by the Delhi court and the high court

The case was tried by the Delhi court and the accused, Shakuntala, Laxman and subash were convicted of murdering Sudha based on the evidence. They appealed to the high court, which gave a judgment that Sudha had died of accident and set the tree free. Enraged women all over India, opposed this verdict and filed a case through the Indian Federation of women lawyers, in the Supreme Court.

The Supreme Court gave the final verdict which accused Laxman and his mother and sent them to life imprisonment and acquitted Subash.
