Douglas decided in favour of YMCA pool because it was safe in contrast to the Yakima River that was treacherous, causing many to drown. The YMCA pool was only two or three feet deep at the shallow end; and while it was nine feet deep at the other, the drop was gradual. That Ymca pool was safe.
