The Election Commission of India, formed on 25th January 1950, gives recognition to political parties in India.

All parties have to register themselves with the election commission and it is only after the legitimate permission of the election commission that the party gains recognition as a political party.

If the commission refuses the party formed owing to any reason then the party has no political existence.
