It was the Supreme Court of India in 1992.

   In 1990 Prime Minister VP Singh of Janata Party government implemented reservations for OBC as per the commission’s recommendations.  An ordinance was passed.  The commission's recommendations were discussed in Parliament houses (both) in 1982.



   However, some students from North of India had filed a petition in the SC against the government order. So Supreme court stayed the order. The arguments against the order were that using caste as backwardness is not appropriate.  Using caste for reservation results in unfair treatment of other castes.  Also the performance of government and public sectors will suffer badly.  


  In 1992 the supreme court upheld the reservations.  SC believed that reservations for OBC will uplift and improve the status of OBC population. SC believed that the caste could be taken as an indicator for backwardness.
