George Jellinek was a public lawyer from Austria. He developed a theory on modern constitutionalism.

  • According to him every state or country needed a constitution to function smoothly and steadily.
  • He stated that constitutionalism existed for a long time in different forms. May it be the ancient time, medieval time, or modern times constitution has always existed in some or the other form.
  • It is always said that a constitution can function without a state but a state can never work without a constitution.
