There's no fundamental distinction that we can definitively establish yet. The truth is that all the intermediates between humans and their ancestors (which diverged from the common ancestor of humans and chimpanzees) are now extinct (and there was likely no fundamental distinction between humans and their ancestors). And there is really no epistemic significance that extant animals hold over extinct animals.

Humans are different than animals because:

1. Can intellegently speak. (Parrots only mimic sounds)

2. Can walk fully upright

3. Are civilized

4. Can choose between right and wrong

5. Do actions out of common sense, not instinct.
