Why did a judge break the pen after declaring the final judgement ?

According to one theory, the judge breaks the nib of his pen because he doesn't want it to be used again for another judgment. The very act of giving the death sentence, or taking the life of someone, is considered so “unholy” that the pen automatically becomes sullied. Hence, the pen is destroyed.

Breaking the nib is a symbolic act. It is done so that the pen which signed the person's life away will never be used to do that ever again. A death sentence, in principle, is a last resort action in dealing with extremely anti-social acts that cannot be resolved in any other way.
