Answer: well to put it simply As others have written here military leaders and some civilians were prosecuted. However the Emperor was deliberately spared on the orders on Douglas McArthur. He believed that Japan would be ungovernable during the occupation period if the Emperor were prosecuted. Consequently he was spared.
