Answer:

Many times Parliament makes laws many a times without much application of mind and it gets passed also.Few examples are:

Declaration of Independence Emergency in 1975 by dictator Indira: It was all passed by Parliament without much discussions as most of the opposition leaders were in jail. Then ratified by most state assemblys also . Was it ever required at all ???? Never.Even Congress MPs like Chandrashekhar ,Krishnakanth ,Mohan Dharia were all thrown out of party and jailed. So you expect this decision of a govt we all shud accept ??Even my own uncle who was a just a participant ,had 5 children and a small job of Rs600/- per month salary was in jail without trials for nearly 19 months .How his family will survive as he was the sole bread earner ????

Information technology act 2000 section 66A: it was passed by Parliament without much study to ensure cyber security etc and 66 A was a loose canon which police cud use for detention of anyone ,wherein two young girls were arrested on some innocuous face book posts.

This totally illogical law section 66 A was brought down by a young but determined girl student by name Shreya Singhal in 2015 .

The National judicial appointments commission act passed by Parliament and half the state assemblys and incidentally 99 the Constitution amendment also was struck down within 6 months of Gazetting it ,by two determined lawyers Ram Jethmalani and Prashant Bhushan .and petetioner was Supreme Court Advocates Association .This bill was supported by all parties and judiciary which was selecting the SC and HC judges wud have lost that powers and politicians and eminent persons ( which can include an industrialist with Rs 60,000 crores unpaid bank loans can be a Supreme Court judge selector ) .It is bcoz of the active civil society such an act was struck down within 6 months of promulgation .

So let us not assume and trust the wisdom of our parliamentarions alone .We the civil society has to keep thinking and innovating how to safeguard our rights esp freedom of expression given to us by our great fire fathers of constititution makers .

So justification why people don't accept blindly the laws made by MPs and we shudnot .Above are the best examples.

ANSWER:

Society precedes state as an entity and thus the legal duties implemented by state flows from the societal norms and conventions. However, state has a role to enable progress in society keeping in mind the future of the society. This may be unacceptable by the society at the moment for instance when the British sought to remove child marriage and sati from Indian society; these reforms were aimed at long term progressive changes in society. Similar is the case with reservation and law against untouchability in Independent India. It was deemed as the instrument to uplift the lower castes and give them dignity. But it has not yet been achieved because the society takes time to inform itself and cleanse itself off evils that plague it. State does its part in imposing certain laws to enable this process of cleansing
