Rights are necessary because 1. Sustenance of a democracy Rights lay the foundation for a true democratic setup. Without rights the dignity of citizens can not be retained. 2.Protection from own government Rights protect the citizens from the violation or infringement by own government. For example In case of violation of rights by own government the aggrevied party can file a PIL 3.Protection from foreign government Rights act as a guarantee that the citizens of a particular country can not be violated by some foreign government. The right was infringed in example of Guantanamo Bay. Further this also sums up the sovereign side of our rights
