For the most part, what we call justice is merely mitigated revenge, and mitigated revenge can certainly be served, just as revenge can be served. But, if we talk about True Justice, then I think, somewhat in line with the Socratic dialogues, that justice is an ideal that is only ever partially instantiated in the real world but which we are able to aim towards (but not residing in some otherworldly platonic heaven). One can be guided by the ideal of justice in the mitigation of revenge, but if retribution is all that justice is or can be in the real world, then I hesitate to say that it can ever be truly served. Even when every sane person agrees that the punishment is well deserved

There is another idea, that justice is the state in which individuals are at liberty, and when one transgresses against another the role of the justice system should be to restore the state of justice, if at all possible. This is an ideal that we can certainly aim towards, but the fact is that the transgression can seldom be undone, and in many cases the state of justice can only partially be restored if at all. The new state of justice is then a state of mutual suffering, perhaps, a balance of the scales of such suffering. And then, how is this any different than simply mitigating revenge.

I don’t know what a true instantiation of justice would look like, I don’t think such a thing is possible for us mere mortals, who hold grudges and keep records of transgressions and demand suffering for suffering. Does one not suffer from the hatred one holds inside while demanding a form of revenge? Should a true instantiation of justice, if such a thing were possible, remove this internal stain, should it not involve forgiveness? That inner movement of the heart which does not alter the past, but alters the meaning of the past. How do we demand revenge and grant forgiveness at the same time? Must we then be forgiven for our demand for revenge?
