Why is an independent judiciary is necessary?​

☆ Independent judiciary is necessary so that the courts (or judges) can take their independent decisions, so as to impart justice in a true manner.

☆ The judiciary is independent so that the decisions made by the judges don't get influenced by the political parties or politicians.

Judiciary refers to the system of courts, which helps us guard our Fundamental Rights, if we think that violations of our rights have taken place.

In India we have integrated judicial system, meaning that the decisions made by the higher courts are binding on to the lower courts.

Appellate system exists in India and this means that a person can go to a higher court, if he thinks that the judgment passed by the lower court is not just.

In India, we have three levels of court:

  • Supreme court- It is at the apex level and only one. Presided by Chief Justice of India. Located in New Delhi.
  • High court- Every state has a court at its apex level, called high court. There are 25 high courts at present.
  • District court- Present in each district of a state. Also known as Subordinate court or lower court.
