Article 129 of the Indian constitution declares that Supreme court shall be a court of record and it can punish for its contempt while article 215 declares every high court of the respective state to be a court of record and the dame can punish for its contempt.

Court of record means a court whose proceedings are put as a record and are available as evidence of fact .Now the question arises ,why only high court and supreme court are court of records and why not district or session court ,even though they hear appeal and there decisions are precedents for their respective lower courts. So the answer would be that the purpose of keeping the record is to make a precedent truly followed .As far as precedent relating to a issue of fact is concerned then it is important, while the one related to issue of law is more important and finally the one related to the validity of act, notification or ordinance is the most important. The same is substantial question of law in code of civil procedure under setion 100 as a second appeal made to a high court or a question coming to a high as a matter of referance from lower court under section 113 of the code .And the same is done by supreme court as a matter of appeal under substantial question of law.And the same guides the lower courts like the magisterial or district ones.

Due to this, these constitutional courts namely supreme court and high court are court of record.

A court of record is a court whose acts and proceedings are enrolled for perpetual memory and testimony. These records are used with a high authority and their truth cannot be questioned. In Indian constitution article 129 make the Supreme Court the 'court' of record
