Jammu and Kashmir has its own flag because the constitution of Jammu and Kashmir make its mandatory to host the state flag along with the union flag of India at all time

After India got freedom, the then established states were ruled by Kings and zamindars.
After the partition of India and Pakistan, Jawahar Lal nehru and Mahatma Gandhi decided to unite whole India by establishing democracy and remove all other small Kings.
They went to all the state rulers to convince them. All the rulers agreed to unite except two rulers. The rulers of Hyderabad and Jammu & Kashmir because they were very mighty and prosperous.
Jawahar lala nehru and ganghiji forced the ruler of Hyderabad and J & K by surrounding them with Indian army. The Hyderabad agreed to all the terms. But the ruler of Jammu and Kashmir imposed a condition on Jawaharlal nehru. He had a condition that the state of Jammu and Kashmir will have different rules and flag. Otherwise, he will merge into partitioned Pakistan.
The first prime minister agreed to the terms and gave the state of Jammu and Kashmir a new Constitution and flag.
