India was finally led into an independent India on August 15, 1947, by its fight against the British, with civil disobedience and non-violence campaigns led by Mahatma Gandhi. The Indian Constitution is the supreme law of India.  It was espoused by the Indian Constituent Assembly on 26th Nov 1949 and was effective on 26th Jan 1950. It sets out the framework that defines the basic policy code, structure, procedures, duties and powers of governmental institutions and defines fundamental rights, the principles of the directive and the responsibilities of citizens. Dr. BR Ambedkar, chairman of the drafting committee, is regarded as the chief architect of the Indian Constitution.

The framing the Indian Constitution was a challenging task for the Constituent Assembly members. Difficulties faced by them in the course of the drafting the Constitution were

  • India is considered for its wide diversity and having being inhabited by a population of various religions, castes, classes and sects. So the constitution had to be drawn up which could meet every part of society's aspirations. It wasn't a simple task.  
  • Upon independence, the people of India emerged as free citizens. It was therefore essential for framers to include in the Constitution all citizens ' rights and duties.  
  • After millions of deaths during the country's partition, India became independent. For the people and drafters of the constitution it was a distressing experience.
  • Several princely states existed in India at the time of independence. Such States were permitted to join India or Pakistan or remain independent, according to the Accession Instrument. It was a complex and difficult task to combine such princely states.
  • After independence, the country went through a difficult phase. The country's future was not that stable at the time as it now seems. The constitutional framers were worried about the current situation and they wanted to form the Constitution, which would keep the country safe and stable in the coming years. They also had to ensure that the constitution's democratic spirit was preserved.
