Explanation:
The Rajya Sabha (Council of States) is the Upper House of the Union Parliament of India. Unlike the U.S. Senate, the Upper House of India’s Union Parliament is not constituted on the basis of equal representation to all states. Seats are allotted in proportion to the population of people of each State or Union Territory. In addition to this, there are 12 nominated members appointed by the President for their excellence in fields like science, art, literature, sports, etc…
The Rajya Sabha has a crucial role in representing the interests of the States at the Centre. There are two provisions that make the Rajya Sabha an important part of government machinery that protects the interests of the States:
- Under Article 249, the Rajya Sabha with the support of 2/3rd of its members sitting and voting has the power to declare that the Union Parliament should make laws on a subject contained in the State list. Upon passing such a resolution, it becomes lawful for the Union Parliament to make laws with respect to that subject for the whole or part of India for a period of one year.
- All India Services are common to both the Union and the States. Therefore, setting up of a new All India Service can alter the powers of State governments and their relaitonship with the centre. Hence, the Constitution provides that a new All India Serivce could be instituted only by the initiative of the Rajya Sabha.
