Article 370 of the Constitution of India was made in history due to clause 7 of Instrument of Accession (a legal document used at time of separation in 1947 by British rulers) signed by Maharaja Hari Singh which stated that Kashmir could not be forced to follow any future constitution of India.

Implementation of Article 370:

“Article 370” is a temporary provision which grants a special rights to Jammu & Kashmir. In 1954 the constitution assembly approved the order to Jammu & Kashmir state. The reason for providing the special status was India and Pakistan were the independence from the British rule. The state of Jammu & Kashmir had option to join with Pakistan or India. Pakistan army attacked the state and threatened the support.

At the time, Maharaja Hari sign was the "ruler of Jammu & Kashmir" and he approached the India for assistance and in this condition the state Jammu & Kashmir would accede to India. According to the "article 370", the constitution of all the provisions which are “applicable to other states” are “not applicable to Jammu & Kashmir”.
