Answer:
The right to property was deleted from the Fundamental Rights of the Indian Constitution in an Amendment made in 1978 to make sure that each and every person in the country has a chance that their property would be lost or under loan. This will help to make sure that the line of boundary between the rich and poor would decrease as each and every one can lose the property if not handled in a correct manner and to maintain a social justice.
Even though it was taken away from the Fundamental rights, it is still considered as a legal and human right.
Facts:
✔ The Right to Property was taken away from the list of Fundamental rights in the 44th Amendment Act of 2978.
✔ Article 300 A of the constitution that makes Right to Property as a constitutional right states that no person can be deprived of his / her property except by authority of law.
✔ The law was challenged in the year 2007 for special economic zones but was rejected by the court.
✔ The 44th Amendment was made by the Janata Party which was under power then.
