Our Constitution is one among the best in the world. It helped us to grow as a single unified nation despite many odds. However even the best has its flaws. I think the following changes would make it much better.

(1) Prime minister and Chief ministers of the state shall be elected by the people and not appointed by party leadership. In the present system people has no voice in who becomes the P.M./C.M.. People can elect only M.P.s and M.L.A.s and it is up to the party leadership to appoint the the leader of the Council of ministers( an indirect election like the presidential election in the United States would be better). This will prevent the defection of M.P.s and M.L.A.s and the so called “horsetrading”that is destroying Indian democracy.

(2) Prime minister /Chief minister can appoint /remove the members of his cabinet ie, other minsters. The other ministers need not be members of the legislature. This will enable the PM/CM to appoint efficient persons as ministers .

(3) Amendments to Article 19 clause 4- the freedom to form associations or unions as provided in Art. 19(1)(c) is one of the main hindrance in making India a progressive nation. Our society and polity are controlled by caste system and the main reason why we cant remove the caste system is ignorance and caste based organisations and associations. Every caste based organisations are formed for the benefit of only those people who belong their caste. That itself divide the people into different castes and sub castes. So as long as these caste based associations and organisations exists we cannot remove that centuries old superstition that divide Hindu society that prevents any and all moves that would truly unite us.

(4) Amendments to Article 25(1)- the right to propagate religion is one of the most important rights that causes so much social tensions. If any one wants to profess or disseminate the tenets of his religion he may do so without causing any disturbance to others. This right is widely misused to convert people especially the innocent tribal people against their will.

(5) Amendments to Article 30- this article is used in such a way that the businessman belonging to a linguistic or religious minority is given special status and protection. In today's world most educational institutions are nothing but a business to obtain profit. Imagine two persons starting an engineering or medical college. Both started the college to obtain profit. The college formed by the person belonging to a minority community is given undue protection that the state cannot impose much control or regulation over it however the other college formed by the business man belonging to majority community is subjected to all those regulations. Both have made the investment for the sole purpose of profit and not for the benefit of their community- minority educational institutions will not say no to a student with the means to pay the fees just because he does not belong to the community of the owner of the college. Moreover this article effectively limits the ability of the state to introduce regulations in the interest of the students.

These are some of my suggestions for amendments of our constitution. “JAI HIND”
