Ground water becomes a rising source of freshwater in India and is dependent on groundwater, accounting for about 60 per cent of irrigated agriculture and over 80 per cent of drinking water needs. The exponential growth in groundwater extraction has led to deteriorations in water quality and in volume over the last decades.-
Such innovations demonstrate the need for a regulatory framework for groundwater use and the conservation of aquifers. This is particularly important because Indian groundwater uses are currently rudimentarily or partially limited. One of the main factors encouraging indiscriminate use of groundwater was a lack of adequate legislation. Unfortunately, administrative boundaries continue to govern the existing law regime and it focuses on the regulation of groundwater use through a licensing / permit system for installing groundwater pumps and tube shafts.
This common law rule is likely to be impractical, inter alia, due to two particular developments. The depletion of groundwater, firstly, would affect the fulfilment of the fundamental right to water which is included in the fundamental right to live enshrined in the Constitution, provided that the overwhelming majority of drinking water nowadays comes from groundwater. Secondly, the Public Trust (PTD) is one of India's most important principles for water resources. The current groundwater rights scheme is directly at odds with PTD as PTD demands that everybody have equitably access to critical natural resources like water.
Hence, considering that no equity or protection of groundwater use is assured by the current regulatory framework in India, reforms in groundwater legislation therefore require a completely new set of standards, strategies and institutional structures.
