The Constitution of India provides constitutional protection to a person who has been arrested, two of the constitutional rights are as follows:

  • Under article 22(2) of the Indian Constitution, the person arrested has the right to be informed on what grounds he is being arrested. This is a very important right provided to the arrested person as this can help the person to move further for bail, etc.
  • According to article 20(3) of the Indian Constitution "No person accused of any offense shall be compelled to be a witness against himself". According to this, the arrested person has the right to silence for his/her own sake.
