Answer:Abortion or Medical Termination of pregnancy ACT of 1971 allows a pregnant women or a girl irrespective of her marital status to have choice of either to go ahead with the birth or terminate the pregnancy.
As per the MTP Act, abortion decision should be taken before 20 weeks as post this period abortion will qualify as a crime as per the Indian Law. The time limit of 20 weeks looks reasonable as it gives enough time to the person to decide. This is in stark contrast to the limited options available to women in countries like Norway, where in spite of clear signs of serious threats to life of a pregnant Indian women, authorities did now allowed the abortion and women has to give her life during the delivery.
In India, abortion is allowed even after the deadline of 20 weeks but prior permission from an appropriate authority like a High Court or Supreme Court should be taken.
However, it should not be used as a precedence as it will lead to several such request of abortion of a fetus which had well passed the 20 weeks deadline.
The right approach should be to educate the girls and the women across the country about the choices available to them through the MTP Act and how to use it to ensure their well-being.
There is some resistance to the rights which this act offers and people are divided into two groups – “Pro Life” and “Pro Choice”. The Pro Life group reasons that the life of a fetus is not less important than the life of a grown up living being and we don’t have any right to take that away. These activists totally disregard the difficulties which an unmarried teenagers or a women has to endure, if they were to go ahead with these deliveries.
Every year lakhs of pregnant women are diagnosed with fetus having serious genetic or physical abnormality. Should we, knowingly, how tough the new world will be for the yet to be born, bring her or him to life?
Then, we also have the case of unplanned or accidental births. Often women are either fearful to disclose or are not aware of their pregnancies till the signs become obvious. If we force them to give birth to every such pregnancies, we will be doing a disservice to Nation and its resources which are already under a great stress.
To make the most meaningful impact of the MTP Act, Government has to bring together all the stakeholders like Panchayats, Local Bodies, and Member of various social groups like Aanganwadi, Saathi etc. to educate women from all walks of life and in all parts of the country.
The Pro Life activists or groups should also be taken on board and engaged in dialogue so that they understand the problems which women may face if they don’t have the right to abortion.
