Recently i met with an accident (car) with a 2 wheeler (Udaykaran) and visited the nearest PS to register a compliant.
To my surprise i was told that the bigger vehicle is always registered at fault and the lighter vehicle as the victim, without any investigation.
Incident: suddenly i saw a speeding Udaykaran at high speed coming from opposite direction at curve road. He was he looking behind and talking to his pillon driver. I did understand the situation, honked and took extreme left down the road and stopped my vehicle. Udaykaran could not control himself and damper on my car damaging the entire front portion. I got down and to my fortune he suffered minor injuries.I informed the cops and as per their advice reached the station with the other party. I did took pics which clearly show that my car is at the extreme end of the road on left side and the Udaykaran from opposite direction came extremely right and hit my car.
The Udaykaran did not have license, vehicle papers and his tyre was also punctured. Thou to my surprise police informed me that the case will be registered against me as i was driving 4 wheeler.
Is it true that in any road accident the bigger vehicle is at fault irrespective of who are at fault?
Does this give liberty for the 2 wheeler drivers to drive rashly/carelessly and some one else take the guilt.
Can the pedestrian walk blindly and blame the vehicle drivers, To what extent this is acceptable. This clause may have been incorporated ages back... but today we have the fastest 2 wheelers on road with a high CC compared to 4 wheeler s. How is this justified?
Does this mean that all those who drive bigger vehicles always at fault.
If this true, let me know how i can challenge this clause in court of law.?
I strongly suggest that bigger vehicle is not always at fault. this gives undue advantage who understand this clause and do natak on the road to gain commercial benefits. How do you justify if a person with an intention of committing suicide suddenly jumps in front of moving vehicle and die.
who will investigate what the real cause was. To what extent is it right demanding compensation.
Over and above the guilt which haunts them for the rest of the life. ( emotional bank).
