Formation of Legislative Council:
The Legislative Council of a state needs to have at max one-third of the total members of the Legislative Assembly of that state. The minimum number of members provided for the formation of Legislative Council is 40.
Powers and Functions of Legislative Council:
1) a legislative council has limited powers in the matter of financial concerns. It cannot generate a money bill but can only give its concern on the same.
2) even in the case of constituent powers and control over the executive, the Legislative Council's opinion is after the opinion of the Legislative assembly of a state.
3) it elects its Chairman and Deputy Chairman
4) Any bills other than the money bills can be introduced in the Legislative Council.

The legislative councilor Vidhan Parishad is the upper house of the legislative assembly. It has less than 1/3rd of the member of the Vidhan Sabha. Their members are known as MLC.
They have usually no powers. They cannot pass the bill but can delay the passage of bills for the last 4 months. However, to pass a bill both legislative council and legislative assembly permissions are required.
