1) Banking and defence are the subjects of the Union List. These subjects are included in Union List because these subjects are of national importance

Indian Constitution is federal in character. In a federal Constitution, there is distribution of powers which is mentioned in Article 246. The explanatory memorandum of Article 246 is Schedule VII. It talks about the distribution of powers into Union List, State List and Concurrent List.

  • Union List - Only the central government will have the right to make laws. It includes foreign affairs, defence, banking, Ports, Railways, Highways, and Communication.
  • State List - Only the state government will have the right to make laws. It includes Public order, Police, Public health and sanitation, Hospitals and dispensaries.
  • Concurrent List - Both central and state governments have the right to make laws. It includes Education, Forest, Trade unions, Marriage and Adoption.

2) The Eighth Schedule of the Indian Constitution mentions that there is no national language in India. Hindi was identified as the official language. But Hindi is the mother tongue of only about 40 percent of Indians.

Therefore the Central Government responded by agreeing to continue the use of English along with Hindi for official purposes. The promotion of Hindi continues to be the official policy of the Government of India. Promotion does not mean that the Central Government can impose Hindi on States where people speak a different language.
