If the transfer certificate is not issued, file the affidavit with same facts before the new school and ask for exemption. But at least you must have marks sheet. If they agree it is well and good, otherwise one has to file a case on school before civil court of local jurisdiction or one can approach high court directly as right to education is fundamental right under ARticle 21 A of Constitution of India.
yes another option is to go for DDPI of that local area. i.e. Deputy Directorate of Public instruction who looks after the education and also regulates the irregularities of education
