It was in 1934 that the idea of a Constituent Assembly for India was put forward by MN Roy for the first time. In 1935, INC for the first time officially demanded a Constituent Assembly to frame the Constitution of India. The demand was accepted by British Government in August Offer of 1940. In 1942, Sir Cripps came to India with a draft proposal by British Govt for framing of an independent Constitution for India to be adopted after World War II. It was rejected by Muslim League for they wanted two separate Constituent Assemblies, one for the Muslims. Finally a Cabinet Mission was sent to India in 1946, with Sir Cripps, Lord Lawrence and AV Alexander. It put forth a scheme for one Constituent Assembly (CA) which more or less satisfied Muslim League.
TheConstituent Assembly was constituted in Nov 1946 under the Cabinet Mission Plan. Features:
1) Total members = 389. British India = 296. Princely States = 93.
2) Each province and princely state to be allotted seats in proportion to their population.
3) Seats allocated to each British province were to be decided among the three principal communities - Muslim, Sikh and general (in proportion to their population).
4) The representatives of each community were to be elected by members of that community in legislative assembly indirectly by means of single transferable vote.
5) The representatives of princely states were to be nominated by the heads of the princely states.
Thus CA was a partly elected and partly nominated body. The election for the membership of CA were held in July - Aug 1946. INC won 208 seats, Muslim League won 73 seats, remaining 15 went to small groups or independents. Princely states did not participate in CA.
The Assembly comprised representatives of all sections of Indian society - Hindus, Muslims, Parsis, Sikhs, Anglo Indians, Indian Christians, SCs, STs, including women of all sections. It included all important personalities of the time, except Gandhi and Jinnah.
