Equilibrium means that there is no performance, there is no work. In case of living organisms it is not true so they do not fall in this category as they are working all the time. Also they have concentrations of bio molecules in them that are in a metabolic flux and without metabolism there can not be any life. Hence, Living state is a non equilibrium steady state to be able to perform work.
