Day and night are not eqaul because of that Rotation of the Earth causes night and day to alternate. Since we learned that the Earth's axis is tilted and hence the equator is not facing the Sun directly, different places on Earth would experience unequal length of days and nights—not exactly 12 hours of dayand 12 hours of night all the time.

Days and nights are not of equal duration because of the earth’s movement around the sun in an elliptical path.
Explanation:
- The earth rotates not around a perfectly vertical pole but at a slated stance. This leads to a part of the Earth reaching more of the sun rather than the opposite end.
- The day that faces the sun around the slated axis experiences day and the rest of the Earth gets the night.
- As along the elliptical orbit, the position of the Earth changes, so the day and the night duration changes as well.
