Most of the modern countries follow the practise of law as a deterrent. This notion is based on reform and to rehabilitate offenders and hence we do not chop off an arm for stealing or chemically castrate for rape.
Deterrence theory in itself makes three assumptions. It assumes that people:Know what the penalties for a crime areHave good control over their actionsThink things through and make choices about their behavior based on logic, not passion.
This is where the laws for protection of women, especially fail terribly. Most of the crime against women are crime of passion, and rarely premeditated. A crime of passion is not made by a sound mind, not by some capable of taking logical decisions by weighing the pros and cons of the outcome. A crime of passion has to dealt by increasing the awareness among the people about the outcome of their act. At least in India, we very rarely see a rape survivor declaring publicly how the incident affected her on a personal level, this kind of awareness is needed for the crime against women.
