A right is something you have.

A claim is something you assert you should have.

So a civil right — right to own a gun, for instance — is yours. You need not prove anything to have it, and it cannot be abridged (taken away) without due process (proof you've done something to disqualify yourself).

A civil claim says someone wronged you, here's the evidence, they owe me a remedy.

In physical property, you have a right- of-way, which you can use even if you do not own it, such as a street, highway, or easement on another person's property necessary to allow you access to your property.

You can “stake a claim ” whereby you show you have satisfied a legal condition to take possession of the property.

With a right they have to prove you can't have it.

With a claim you have to prove you can have it.
