In the law of evidence, a dying declaration is testimony that would normally be barred as hearsay but may in common law nonetheless be admitted as evidence in criminal law trials because it constituted the last words of a dying person.

As per section 32(1) of Indian Evidence Act, dying declaration means a written statement which is made by the person who is dead or you can understand that it is the statement or words before the death and we call it is as a dying declaration.
Normally prosecution introduced dying declaration and when sometimes a person who is about to die and giving a statement then also it will be taken as dying declaration.
