Does Everyone Have Access to the court ?

Yes, every citizen has a right to justice to the court

But according to Reality - while the Court are available for all , in reality access to Court has always been difficult for a vast majority of the poor in India

( REASON )

Legal procedure involves a lot of money and paperwork as well as take up a lot of time .

For poor person who cannot read and write , their family depends on the daily wage , the idea of going to court to get justice often seem remote.

But now what did government do to resolve this problem !

the supreme court in the early 1980s devised a mechanism of ( PIL ) public interest litigation to increase access to justice.

Now the question in our mind is how ?

it allow any individual or organisation to file a PIL In the high court court of supreme court .

Even a letter of telegram addressed to the supreme or high court could treated as PIL .

Another issue that affect the common person's access to justice is long number of year that court takes to hear access and we know that justice delayed is justice denied .

However in spite of this there is no denying that Judiciary has played a crucial role in democratic India serving as a check on the power of Executive and legislature as well as in protecting the fundamental rights of citizens .
