Constitution is the most important in firstly giving fundamental rights to each and every citizen of the country like right to speech. There are some duties to be followed too even where the vandalism is extended to be illegal which could effect public properties reducing chances of violence.
One can approach court is he/she feels that she can't excersice her rights with all Liberty. But misusing these rights leads to very high chances of imprisonment.
