The government may restrict these freedoms in the interest of the independence, sovereignty, and integrity of the country and in the interest of morality and public order. However, it cannot suspend the right to life and personal liberty.

The limitations to the Right to Freedom provided under the Fundamental Rights section of our constitution are:

  • The Fundamental Rights include 6 rights given by the Indian Constitution to all Indian citizens.
  • They include the Right to Equality, the Right to Freedom, the Right against Exploitation, the Right to Freedom of Religion, Educational Rights, and the Right to Constitutional remedies.
  • These rights are absolute except in some situations.
  1. The Right to Freedom and Speech Expression can be suspended if a state or national emergency is declared as per Article 352 of the constitution.
  2. A person held in a conviction for an offense cannot be punished more than once for the same offense.
