Jailbreak is legal (since everyone has a right to live freely) but trespassers are often fined with additional charges that were necessary to fulfill the act of jailbreak (theory of equivalence).
Some examples:
1. Die Klassiker: digging a tunnel underneath your cell can be charged with theft (of the spoon) and vandalism of a public domain (i.e. a jail)
2. Blowing up a wall to freedom is obviously vandalism of a public domain as well.
3. Landing with a helicopter on the roof - which might seem farfetched but did happen in Brugge, Belgium - is obstruction of public order
4. Keeping a patrol officer hostage is kidnapping...
So jailbreak is legal, the act of jailbreak isnt
