Religious freedom in India is a fundamental right confirmed by Article 25-28 of Indian Constitution.

Modern India came into life in 1947 and the constitution's preamble was amended in 1976 to tell that India is a secular state.  

S.R Bommai v. Union of India Supreme Court of India told that India was a secular state from the time in its constitution what actually was done through this amendment is to tell explicitly what was before contained implicitly under article 25 to 28.  

All citizens of India has right to practice and promote their religions activity.

India is a country with a tremendous religious sentiment and Indians are known to celebrate each and every festival irrespective of the caste, creed and religion.


So, it is a huge responsibility on the part of the administration to implement rules and provisions for individual religious festivals.


Some such legal provisions are as follows:


• Granting permission to slaughtering of goats and sheep during Bakri Eid


• Granting permission to goats during Kali puja in Kali temples


• Cleaning and proper lighting facilities by the respective municipal corporations during any big festival


• Application of pesticides, mosquito repellent sprays, bleaching powder to dengue and malaria prone areas during the festivals


• Proper parking facilities and opportunity to walk safely by the pedestrians during big festivals like Durga Puja, Diwali etc.
