u can't define which situation he is referring to actually...its a controversial issue...Both the tenses are correct..

I know that too...but in english sometimes sentences don't sound natural...but according to the rule book it's ok..
He is referring to his conversation to the person in the past, he said that he was, it could be that the person at present isn't well
it could also be that he's fine in the present situation....so that's why both are correct...
Dam.n, anyways, use past or lose your marks...That's all
I have used present tense many times and gained marks....I don't know about losing....
