Whenever the office becomes vacant, the new President is chosen by an electoral college consisting of the elected members of both houses of Parliament(M.P.), the elected members of the State Legislative Assemblies (Vidhan Sabha) of all States and the elected members of the legislative assemblies (M.L.A.)

Procedure for President election in India:-

When a President is to be impeached for violation of the Constitution, either House of Parliament can level the charge as follows:-

  1. 'Resolution which is moved after at least fourteen days' notice in writing sign by 1/4 of the total number of the House.
  2. The resolution is passed by a majority of not less than two-third of the total membership of the house.

  • When there is charge preferred by either Houses of Parliament ,the other House will inviestigate the charge and the President has the right to appear and to be represent at such an investigation
  • If in a investigation the resolution is passed by a majority therefore not less then 1/3 of the total member of House such resolution has power of removing the President from his office.
