This excerpt is an example of judicial review.  Supreme Court Justices in the US are appointed for a lifelong tenure.   Here we are analysing the judicial review on the Tinker vs Des Moines case.   Here validity of freedom of speech and expression within the schoolhouse gate are being discussed.   The supreme court has been holding this argument since the past 50 years.
