In legal parlance Independence of Judiciary mean the power of upholding without fear or favour, the Rule of Law, personal freedom and liberty, equality before law and impartial and effective judicial control over administrative and executive actions of the Government.

It is vitally important in a democracy that individual judges and the judiciary as a whole are impartial and independent of all external pressures and of each other so that those who appear before them and the wider public can have confidence that their cases will be decided fairly and in accordance with the law.

Indian judiciary is considered an independent institution because: It does not fall under the control of the legislative or the executive. The judges do not act on the government's direction or in the favour of the ruling party.
