Under sec 43 of IT act 2000 following is mentioned:

[Penalty and compensation] for damage to computer, computer system, etc.–If any person  without permission of the owner or any other person who is in charge of a computer, computer system or  computer network,–

-access, download data, damages etc activities are mentioned in the clause. However, it has not mentioned that how much maximum penalty could be imposed.

Penalty amounts could only be imposed by the judicial authority on the basis merits of claim.
