Washington, an insane person p of limited means, entered into a contract with Lincoln for purchase of an antique axe and a cherry tree for $100. The price paid for both of these items was fair and reasonable and, Washington refused to take delivery of either the axe or the cherry tree, or to pay for them.
Can a mentally unsound person enter into a contract.
Was there a valid contact between Washington and Lincoln for the purchase and sale of the antique axe and cheery tree for $100.

Answer: No. a mentally unsound person cannot into a contact.

According to the 12th Section of the Indian Contract Act ,1872 a person who is not capable of making his own decisions during the time of the making of the contract is not eligible to agree on the terms of the contract if any such contracts are made in which a person who is mentally not stable or a person who is not able to make decisions due to some mental problems then the following contract is said to be void.

So No , the contract for the purchase and sale of the antique axe and cheery tree for $100 made between Washington and Lincoln was termed void as Washington was a mentally unsounded person.
