a) Some of the provisions of the constitution can be amended by simple majority of the parliament. Ex. Creation of a new state, creation or abolition of upper house of state legislature.
(b) Certain provisions of the Constitution of India can be amended simple majority of the house and two-thirds majority of members present and voting.
(c) Finally, some other provisions can be amended by two-thirds majority of the Parliament and ratification by the majority of the State Legislatures.
Following all the provisions in the constitution is the function of parliament. Nothing can be done against the rules prescribed in the constitution.
With the GST bill, our constitution has been amended 100times so far which shows that it can take a change with the changes needed with the society. Every politician and political party have to abide by the laws provided by the constitution. And every citizen was given freedom to raise his voice against anyone who grabs his Fundamental Rights.
Supreme Court is at the helm of affairs and it has the most important function of interpreting the constitution incase of any misunderstanding . It is the function of the Supreme Court to guard whether everything is going as per the constitution. Constitution is a ‘living document’ which has got life embeded in the franchise gifted to its citizens.
