Judicial Independence is the concept by which judiciary should be independent from the other branches of the government. Judicial independence serves as a safeguard for the rights and privileges provided by the limited constitution and prevent executive and legislative encroachment upon those rights.


Examples are like Canada, Hong Kong, Singapore, UK,USA has a judicial independence system entrenched in its constitution.

Judicial Independence can be referred to the ability of courts and judges to perform their duties free of influence or control by other actors such as government or private.

  • The term is also used in a normal sense to refer the kind of Independence that courts and judges ought possess.

  • The other organs of the government like the executive and the legislature must not restrain the functioning of the judiciary in such a way that is unable to do and serve justice.
  • The Other organs of the government should not interfere with the decision of the judiciary. Judges must be able to perform their duties without a favour or fear.
