1.When a person, arrested on suspicion of committing a non-bailable offence, is produced before a Judicial Magistrate (JM) and remanded to any custody, he ( the arrested person) will have to apply for bail before the same Court (JM).
If the prayer for bail is refused by the JM, the person accused may apply for bail before the Court of Sessions Judge of his district, or before the High Court of his State.
