The motion by 64 Rajya Sabha MPs to challenge the credibility of the Chief Justice of India Dipak Mishra was rejected by Vice-President Venkata Naidu due to the following reasons:

Article 124(4) and Article 217 of the Constitution require an examination of such motion, Article 124(4) uses two issues viz.: “proved misbehaviour” and “incapacity”, And since the members who have moved the motion were not sure of their own case, the requirement was not fulfilled.

Because there’s no proof beyond doubt which is required to make a case of proved misbehaviour under Article 124(4).
