Society precedes state as an entity and thus the legal duties implemented by state flows from the societal norms and conventions. However, state has a role to enable progress in society keeping in mind the future of the society. This may be unacceptable by the society at the moment for instance when the British sought to remove child marriage and sati from Indian society; these reforms were aimed at long term progressive changes in society. Similar is the case with reservation and law against untouchability in Independent India. It was deemed as the instrument to uplift the lower castes and give them dignity. But it has not yet been achieved because the society takes time to inform itself and cleanse itself off evils that plague it. State does its part in imposing certain laws to enable this process of cleansing.
